The Kerala High Court has dismissed the police protection plea preferred by expelled Congress leader Simi Bell Rose John against Chief Minister V.D. Satheesan and his brother, V.D. Ajayakumar. [2026 LiveLaw (Ker) 462]

Justice Bechu Kurian Thomas observed that Simi has not pointed out any materials to show that her life or property were under threat from the Chief Minister (5th respondent) or his brother (4th respondent).

The Court further noted that the police inquiry conducted on the basis of her complaint also did not reveal any existing threat. It further noted that there may be a personal grudge against CM Satheesan.

"it needs to be mentioned that the 5th respondent was, at the time of filing the writ petition, the Leader of Opposition in the State Assembly and is presently the Chief Minister of Kerala. The petitioner was a former All India Congress Committee Member and a former PSC Member and subsequently expelled, allegedly at the instance of the 5th respondent. It is an indication that there could be a personal grudge against the 5th respondent. In the absence of any material to indicate any threat from the part of respondents 4 and 5, and in the light of the enquiry conducted by the police, this Court is of the view that grant of police protection is not proper," the Court observed.

Simi had alleged that CM Sathessan had expelled several veteran politician, including her, without any valid or justifiable reasons. She alleged that she was facing threats from CM Satheesan and his brother, and that her son was attacked in Delhi allegedly at their instance. She also pointed to an attack against her associate.

The Inspector of Police, Ernakulam Town South Police Station filed a statement wherein it was stated that no serious instances of any existing threat is there against Simi. It was further stated that the attack on her associate was due to a family dispute whereas there were no records regarding that against her son. Moreover, Simi did not disclose any specific details on the attack, it was stated.

After hearing the parties, the Court noted that no crime was registered pursuant to the alleged attack against Simi's son and that there were no materials to connect the attack against CM Satheesan and his brother.

The Court thus dismissed the plea, finding no merit in the same.
