MP High Court Orders Penal Action Against Woman For Falsely Accusing Senior Advocate Of Rape, Says She Snatched His Right To Dignity

The Madhya Pradesh High Court has ordered penal action against a woman, who falsely accused a Senior Advocate, having a standing of 20 years at the Bar, of committing rape upon her two year old daughter by breaking into their house at night.Justice Vishal Mishra was irked at the woman, who "did not care for the future of her own daughter", and was more interested in "settling her personal scores" with the senior counsel who refused to pursue her matter over moral grounds.As per the counsel, the woman had approached him to file a revision petition but on going through the records he found that she has a habit of making frivolous complaints in order to blackmail people. So he asked her to engage another advocate.This purportedly fueled her to file repeated complaints against the senior counsel, including an FIR alleging that he raped her inside the High Court premises."This not amounts to humiliation, causing harassment physically and mentally and tarnishing the image and reputation of the person made accused, in the entire society, which snatches away the right to live with dignity," the High Court observed.After investigation and upon finding no material against the senior counsel, the Police had filed a closure report in the matter, pending final decision by the Trial Court.The High Court deemed it fit to quash the proceedings, stating "prosecution against the petitioner cannot be permitted to continue even for a minute."It further ordered the Superintendent of Police of the area to take immediate action against the woman under Section 22 of POCSO Act, 2012 and Sections 240 and 248 in BNS, 2023 for making false and frivolous complaint against.Case Title: PU v State of Madhya Pradesh (2025:MPHC-JBP:44212)Citation: 2025 LiveLaw (MP) 189For Petitioner: Senior Advocates Anil Khare and Naman Nagrath with Advocates Chandrahas Dubey, Vikas Upadhyay, Ravindranath Chaturvedi, Ramnath Dwivedi, Hitendra Golhani and Utsarg AgrawalFor State: Government Advocate A.
