The Madhya Pradesh High Court issued notice on Monday (January 5) in a public interest litigation raising concerns over the lack of maintenance and irregular activities being conducted in Chandrashekhar Garden, located in Vijay Nagar, Jabalpur.
The division bench of Chief Justice Sanjeev Sachdeva and Justice Vinay Saraf directed;
"Issue notice. Notice is accepted by learned counsel appearing for respondents No.1 and 4. Notice shall issue to respondents No.2 and 3; returnable within four weeks".
The petitioner, a social worker, claimed that the Nagar Palika Nigam Jabalpur is responsible for the maintenance, cleanliness and development of the said garden. The petition stated that the Nigam failed to fulfil its responsibilities, leading to theft of lights, illegal grazing of cows and events of assault and fights.
The petition claimed that multiple representations were filed before the authorities seeking to preserve the sanctity of the garden, but no measures were taken to decide on his representations. The petitioner also moved an application at the CM helpline.
Therefore, the petition sought directions against the concerned authorities to take expedited steps in deciding the representations within a stipulated period. The petition also referred to another petition filed by the petitioner before a single-judge bench. The bench had dismissed the petition as withdrawn while advising the petitioner to file a public interest litigation as the petition involved a larger question relating to public importance.
