Circular Issued To Prevent Non-Academic Activities In Educational Institutions: TN Govt Informs High Court On CM Vijay Birthday Celebration Row

    The Tamil Nadu Government, on Monday (July 13), informed the Madras High Court that the School Education Department has issued a circular to prevent any non-academic activities in educational premises.

    Advocate General Vijay Narayan made the submissions before the bench of Chief Justice SA Dharmadhikari and Justice G Arul Murugan, which was hearing a plea filed by former AIADMK MLA VBP Paramasivam seeking direction to the Union of India, the Higher Education Department, the School Education Department, the Tamil Nadu Commission for Protection of Child Rights, and the Director of School Education to take immediate action against the use of educational institutions for political exploitation.

    The matter relates to the alleged celebrations carried out by the members of the Tamilaga Vettri Kazhagam (TVK) in connection with the birthday of party head and Chief Minister Joseph Vijay, on June 22.

    The petitioner had argued that N Anand, General Secretary of the ruling TVK party was misusing educational institutions for political propaganda. He had thus approached the court to protect the constitutional and educational rights of the children guaranteed under Articles 21A, 39(e), 39(f) and 45 of the Constitution of India.

    When the plea came up for hearing, the bench pointed out that a similar plea was already pending before it, in which the court had already issued notice. The bench thus questioned the filing of a second plea seeking similar relief.

    "Already, one case is pending. Why are you filing so many cases one after the other?" the court asked.

    At this point, the AG informed the court that the State had already issued a circular in this connection on July 10, and on the basis of the circular, such an incident will not happen again.

    The court also opined that in view of the circular, nothing remained in the case.

    Following this, the petitioner requested the court to withdraw his case, which was allowed by the bench. The matter was thus dismissed as withdrawn.

    It may be noted that another plea, filed by a councillor of the Greater Chennai Corporation, to ensure that educational institutions in the state are not used for political, ideological, communal, personality glorification, divisive, or any other activities unrelated to the educational objectives. The matter is pending before the court, and the bench has issued notice in the same. As an interim measure, the petitioner had also sought the suspension of heads of educational institutions who had permitted political activities in the educational institutions recently.
