[NSA] Article 21 Can't Be Stretched To An Extent Which Leads To Law & Order Situation: Punjab Police Opposes Plea Of Amritpal Singh's Alleged Aide

The Punjab Police has opposed in the Punjab & Haryana High Court, the plea filed by alleged aide of 'Waris Punjab De' organisation's chief Amritpal Singh challenging his preventive detention under National Security Act (NSA).Sarabjit Singh Kalsi is lodged in Dibrugarh jail, He was arrested on the grounds of being a "close associate of Amritpal", "vandalising Ajnala Police Station" and "for promoting agenda of Ampritpal's organisation to succeed Punjab.Police has said Kalsi cannot be given the benefit of Article 21. It said the provisions and preview of Article 21 cannot be stretched to an extent which leads to law and order situation.The reply filed by SSP Amritsar says,"Infact by taking the benefit of Article 21 the petitioner will be give right life and personal liberty and the whole State and General Public will be at a stake. Thus, the petitioner cannot be given any benefit under Article 21 by misinterpreting and ignoring the other facts and circumstances at the ground level."According to the Police response, Kalsi was actively abetting Amritpal to wage war against the State for a separate nation by the name of "Khalistan".Kalsi is booked under Sections 121-A, 143, 153-4, 153-8, 505 (2) and 188 of the Indian Penal Code, 1860 at Police Station, Moga and also in Ajnala police station attack under Sections 307, 353, 186, 323, 333, 506, 120 8,427, 148, 149 lPC.On the other hand the petitioner contends that he is falsely implicated and detained under NSA since 8 months "without any arrest or trial". The plea also states that the organisation 'Punjab Waris de' was formed aiming Farmers reforms and to resolve Drugs menace in Punjab. Punjab Police claims the detention is well-reasoned, in accordance with law and has been granted approval by the State Government, Central Government and a committee formed under the supervision of retired High Court Judge.AAG Aman Pal appeared for the State and Advocate Navkiran Singh appeared for the petitioner.Case Title: Sarabjit Singh Kalsi v.
