Punjab & Haryana High Court Stays Probe Against 32nd Avenue CEO Dhruv Dutt Sharma In Multiple FIRs Barring One Cheating Case

The Punjab and Haryana High Court last week stayed probe in multiple FIRs registered against Gurgaon's 32nd Avenue CEO Dhruv Dutt Sharma who has been accused of selling the same unit to several buyers. The high court however made clear that investigation in one FIR (FIR No.262 of 2025) lodged under IPC Sections 409(Criminal breach of trust by public servant or by banker, merchant or agent, etc.) , 420 (cheating) and 120-B(criminal conspiracy) at Police Station Civil Lines in Gurugram shall continue. 32nd Avenue is a dining and entertainment real estate hub located in Gurgaon. For context FIR No.262 of 2025 is the first FIR lodged against Sharma on the complaint of an individual alleging failure to pay rent in respect of a commercial unit booked by his son in December 2021. It was alleged that since June 2025 rent was not paid by the petitioner. The court was hearing Sharma's plea challenging multiple FIRs lodged against him. Appearing for Sharma, senior advocate RS Rai argued that there was no offence under BNS made out against Sharma and it was only a dispute between the landlord and tenant regarding non payment of rent. It was submitted that if the landlord is aggrieved, then he can file an appropriate petition before the concerned authority. It was further argued that there are five shops in one shopping complex and five different FIRs have been registered against the petitioner just to harass him just so that if he gets bail in one FIR, then he will be arrested in second and so on. Issuing notice on the petition, Justice Subhas Mehla in his order said:"Notice of motion for 08.04.2026. In pursuance of advance notice, Mr. Karan Veer Singh, Sr.DAG, Haryana, appeared and requested for a short adjournment for filing reply. Notice to remaining private respondents be issued for date fixed. Dasti, as well. In the meanwhile, except the first FIR No.262 of 2025, under Sections 409, 420 and 120-B IPC, registered at Police Station Civil Lines, Gurugram, the State is directed not to proceed with other FIRs, till the next date of hearing"The petitioner's counsel also relied upon the law laid down by Supreme Court in State (NCT) of Delhi versus Khimji Bhai Jadeja (2026) as well as order passed by high court's Co-ordinate Bench in Ashish Bhalla vs. State of Haryana and others.The petition has been filed by advocates Sumer Singh Boparai and Prabhav Ralli.
