NEET-PG: Rajasthan High Court Grants Interim Relief To Doctor On Maternity Leave, Stays Adverse Action Over Joining Deadline

The Rajasthan High Court granted interim relief to a doctor who was allotted college pursuant to her clearing NEET PG, and whose representation to the State seeking extension of joining date for the college, owing to her being in post-partum after child birth, was rejected.
While granting two weeks' time to the State for filing reply, the bench of Justice Anuroop Singhi allowed the petitioner to continue her officially allotted maternity leave, and restrained the State from taking any adverse action against her.
The petitioner is an MBBS doctor, posted as a Medical Officer in Sikar. She appeared for NEET-PG and was allotted a Post MBBS Diploma Seat for which she also deposited the tuition fee and security amount. During this period, the petitioner gave birth, and was granted maternity leave till July 19, 2026.
The State had set April 9, 2026 as the last date of joining for the allottees and any failure to join the college as per this last date attracted cancellation of allotment.
In this background, since the petitioner was in postnatal recovery phase, she submitted a representation to the State seeking extension of the last joining date, which was rejected. Hence, the petition was filed before the Court.
While allowing two weeks' time to the State for filing reply to the petition, the Court held that while the petitioner may submit her joining to the State and the college, she would be entitled to continue her maternity leave, and the State shall be restrained from taking any coercive action against her.
