Rajasthan High Court Stays RUHS-CUET 2026 Counselling & Allotment Schedule For Nursing, Pharma & Physiotherapy Courses

Rajasthan High Court has stayed Rajasthan University of Health Sciences-CUET 2026 Counselling and Allotment Schedule for admissions B.Sc. Nursing, Diploma in Pharmacy (D.Pharm) & Bachelor of Physiotherapy Courses, after noting that state government did not act on pending pleas by various institutions seeking No Objection certificates. For context, the Court was hearing a bunch of writ petitions wherein the petitioners had prayed for a stay on the operation of the notification that notified about the scheduled RUHS-CUET 2026 counselling and allotment.The petitioners were various institutions for B.Sc Nursing/GNM courses that had applied for grant of NOCs by the State after establishing necessary infrastructure and other facilities in light of new guidelines for Nursing Colleges/Schools issued in 2014.The applications were lying pending at various stages for more than one and a half years. In this background, the petitioners had sought stay on the counselling process without adjudication on the pending applications.The bench of Justice Mukesh Rajpurohit observed that if the counselling was allowed to proceed before adjudication of the pending applications moved by petitioner institutions for grant of No Objection Certificates (NOCs), the petitioners would suffer irreparable prejudice."This Court had earlier refrained from interfering with the counselling process solely on the assurance given by learned Advocate General that no counselling had commenced and no notification had been issued. However, the notification dated 11.06.2026 now placed on record demonstrates that the counselling schedule has now been notified. If the counselling process is permitted to proceed before adjudication of the pending applications for grant of NOCs, the petitioner-institutions, whose applications have remained pending solely on account of inaction of the respondent authorities, would suffer irreparable prejudice". The petitioners argued that commencement of the counselling process without adjudication on their long-pending applications for grant of NOCs would lead to loss of another academic year for them and defeat the very object of this litigation.After hearing the contentions, the Court observed that the applications had remained pending only on account of State's inaction. Multiple opportunities were granted to the State, yet no action was taken in regard to the pending applications of the petitioners. “This Court cannot lose sight of the fact that the applications submitted by the petitioner-institutions pursuant to the Guidelines dated 15.10.2024 have remained pending for more than one and a half years. Despite repeated opportunities granted by this Court and despite specific assurances extended on behalf of the Stat Government from time to time, no final decision has yet been taken with regard to grant of No Objection Certificates in favour of the petitioner-institution. The delay on the part of the respondent- State continues to remain unexplained.”In this background, it was observed that the conduct of the authorities of withholding decision of the pending application for NOCs, while initiating the admission process could not be allowed. Accordingly, to safeguard the interest of the petitioners, the operation of the counselling and allotment schedule was stayed, till the next hearing. The matter is listed on July 15, 2026.
