Rajasthan High Court Restrains Youth Booked For Cyber Crime From Using Telegram & WhatsApp During Trial

The Rajasthan High Court recently granted bail to a 19-year-old accused of committing cyber crimes after imposing unique conditions on him, including restraining him from using social media apps like Telegram and WhatsApp. Justice Sameer Jain took note of the fact that the applicant is a young man, "who is at fag end of his teen age" and that he had been in custody since 15.07.2025. The court noted that the chargesheet had been filed. Thus without commenting upon the merits/demerits of the case, this Court allowed the bail plea subject to following conditions:The applicant will render all details of the bank accounts operated under his name to the investigating authorities.He will use and operate only one account for his regular personal lawful purposes. He will be using only that SIM Card which was linked and registered with the Aadhar authorities and not attempt to commit or indulge in any unlawful activity using the mobile phone. If he has an additional number operated by him or issued under his name, which was not registered with the Aadhar authorities, it shall be surrendered at the concerned police station. He will render all appropriate cooperation with the police and mark his attendance on the 5th of every monthHe is restrained from using any social media applications like Telegram and WhatsApp during trialHis surety is to be given by a blood relative. The matter pertained to cyber-crime wherein the applicant was accused under multiple sections of BNS, as well as under Section 66 of the Information Technology Act, and Section 13 of the Rajasthan Public Gambling Ordinance, 1949. It was alleged that multiple bank accounts were used malafidely by the accused.The amicus curiae as well as counsel for the State submitted that the area from which the applicant is domiciled, is commonly related to the persons involved in commission of offences of cyber crime in India. It was submitted that different bank accounts were used malafidely, and prima facie allegations are qua involvement of the applicant in commission of cyber crime.According, the bail application was disposed of.
