Tripura High Court Sets Aside Cancellation Of Graduate Teacher's Appointment After University Confirms Degrees As Genuine

    The Tripura High Court has set aside the cancellation of a candidate's appointment as Graduate Teacher, holding that the State had no basis to cancel the appointment after the petitioner produced subsequent genuineness certificates issued by Madurai Kamaraj University, which remained unrebutted by the authorities.

    Justice Biswajit Palit remarked that: “there was no basis on the part of the Director of Secondary Education to cancel the Offer of appointment in favour of the petitioner by memo dated 15.02.2020 … and as such in the considered opinion of this Court, the petitioner is entitled to get relief in this writ petition.”

    Background:

    The petitioner, Bulti Paul was selected for the post of Graduate Teacher in the STGT, 2019 conducted by the Teachers Recruitment Board, Tripura (TRBT), and was issued an offer of appointment by the Directorate of Secondary Education on November 4, 2019.

    However, after a verification report from Madurai Kamaraj University raised doubts regarding the genuineness of her B.A. and B.Ed. certificates, the authorities lodged an FIR against her and cancelled her appointment offer on February 15, 2020.

    The petitioner was subsequently acquitted of the charges under Sections 468 and 471 IPC, following which she approached the High Court challenging the cancellation.

    The High Court observed that the State had cancelled the petitioner's appointment on the basis of the initial communication from Madurai Kamaraj University alleging that her educational certificates did not match its records. However, the petitioner subsequently produced a further communication and genuineness certificates issued by the University confirming her B.A. and B.Ed. qualifications.

    The Court noted that the petitioner had also been acquitted of the criminal charges under Sections 468 and 471 IPC, and the State had not challenged the acquittal. More importantly, despite the petitioner relying upon the University's subsequent genuineness certificates in her rejoinder, the State neither filed an additional affidavit nor produced any material to rebut those documents.

    In these circumstances, the Court held that there was no basis for the Director of Secondary Education to cancel the offer of appointment. It therefore set aside the cancellation memorandum dated February 15, 2020 and directed the respondents to issue a fresh offer of appointment to the petitioner within three months.

    However, since she had not performed any duties during the intervening period, the Court declined to grant back wages.
