The Centre for Law and Urban Development (CLUD), National Law University Delhi, in collaboration with the Society of Construction Law India (SCL-India), is organising a two-day Certificate Course on Construction Contracts and Disputes on 9th and 10th May 2026 at NLU Delhi. The course is aimed at equipping law students, practicing advocates, and legal professionals with the foundational tools to navigate one of India's fastest-growing areas of legal practice.

    About the Course

Construction law sits at the intersection of contract law, administrative law, and dispute resolution and yet it remains one of the most underrepresented specialisations in Indian legal education. This course addresses that gap directly. Unlike conventional academic programmes, the CLUD–SCL Certificate Course is designed with a practitioner-first approach. Each session is led by professionals who have negotiated, administered, and litigated construction contracts in the real world. Participants will not only learn the law as it exists on paper but also how it operates and is contested at the ground level.

The course draws its relevance from the current moment in India's infrastructure trajectory. With the government committing record capital expenditure to roads, railways, ports, and urban infrastructure, the volume of construction contracts being executed across the country has never been higher. Alongside this boom comes a corresponding rise in contractual disputes, delay claims, and arbitration proceedings. Legal professionals who understand the technical and commercial logic of construction projects are in high demand and this course is designed precisely to build that competence.

The programme is structured across two intensive days, each with a distinct thematic focus.

Day 1: Strategic Contracting, Risk Allocation, and Project Control

The first day introduces participants to the structure and lifecycle of construction project and the regulatory and legal framework governing construction activities. Sessions cover the various types of construction contracts including lump sum, item rate, EPC, and turnkey formats. It also includes principles of risk allocation, key contractual clauses, and practical considerations in drafting and negotiation. The day concludes with an in-depth session on international standard forms. This offers a comparative analysis of FIDIC and NEC contracts alongside Indian practices. The contract administration mechanisms with also be examined in detail.

Day 2: Dispute Strategy, Claims Management, and Arbitration

The second day focuses on the practical dimensions of construction disputes. Participants will learn about types of construction claims, methods of delay analysis, and the critical importance of documentation and record-keeping in dispute management. A dedicated session on dispute resolution examines arbitration and its key procedural aspects is scheduled. The role of courts in granting interim relief and enforcement will also be discussed. Alternative mechanisms such as mediation and adjudication boards will be explored. The day culminates in a Final Cumulative Exercise, where participants apply their learning to a realistic scenario. This would involve identifying contractual and legal issues, analysing risk allocation, framing claims or responses, and proposing an appropriate dispute resolution strategy.
