Indian Society Doesn’t Recognise Live-In Relation As Acceptable, Difficult For Woman To Live Alone After It Breaks: Allahabad HC

Granting bail to a man accused of raping his married live-in partner, the Allahabad High Court recently observed that it is difficult for a woman to live alone after breaking of live-in relationship. Opining that Indian Society, at large, does not recognize such relationships as acceptable, the Court added that a woman, therefore, is left with no option but to lodge a first information report against her live-in partner, as it happened in the present case. The bench of Justice Siddharth made these observations while dealing with the bail plea of one Aditya Raj Verma who was arrested on November 24, 2022, on the charges of resiling from his promise to marry her live-in partner."It is difficult for a woman to live alone after breaking of #LiveInRelationship. The woman, therefore, is left with no option but to lodge FIR against her live-in partner": #AllahabadHighCourt pic.twitter.com/5FjAZpOApH— Live Law (@LiveLawIndia) February 23, 2023 Essentially, it is the case of the victim, a married woman, that Verma (applicant) was living with her for the past 1 & 1/2 years and she became pregnant on account of her live-in relationship with him, however, he refused to marry her. It was also alleged that he sent obscene photographs of the victim to her husband and therefore, he refused to keep her with him. On the other hand, the applicant submitted before the Court that the victim is major and she willingly entered into a live-in relation understanding the consequence of such a relation and that there is no allegation that the relation started with the promise of marriage. Having heard the rival contentions, the Court observed that this is a case where the disastrous consequences of a live-in relationship have come into the scene. Consequently, keeping in view the nature of the offence, evidence, complicity of the accused and finding force in the submissions made by the counsel for the applicant and the one-sided investigation conducted by police, ignoring the case of the accused side, the Court granted him bail.
