    In a strict response to the tampering of High Court records, the Bar Council of Gujarat has suspended Advocate Dharmesh Jivanial Gurjar upon finding a prima facie case of misconduct against him.

    This action comes in the wake of the High Court’s order dated 26/10/2023 and 01/11/2023, where the case involving Gurjar was referred to the State Bar Council for immediate disciplinary action due to allegations of personal misconduct.

    A Resolution passed by the Bar Council of Gujarat on 5.11.2023 emphasized the seriousness of the allegations made against the lawyer. The members present unanimously agreed that the conduct of an advocate should be scrutinized in disciplinary proceedings.

    The Resolution stated, “It is unanimous opinion of members present that the allegations made against advocate Mr. Dharmesh J. Gurjar are serious in nature and the conduct of an advocate is required to be scrutinized by the Bar Council of Gujarat in Disciplinary Proceedings.”

    “Therefore, it is unanimous view to take up this matter as SUO MOTU complaint and refer this matter to Special Disciplinary Committee constituted by the Bar Council of Gujarat consisting members of Mr. C. K. Patel, Mr. J. B. Golwala and Mr. Sanjay H. Trivedi for appropriate action. The August House has further resolved that it is expected from the Special Disciplinary Committee to conduct this matter urgently and dispose off the same within a period of 6 months from today,” it further stated.

    The resolution also highlighted the gravity of the advocate’s alleged misconduct during the proceedings before the High Court, deeming it unacceptable. In light of this, the Bar Council unanimously resolved to suspend Mr. Dharmesh Jivanial Gurjar as an Advocate during the pendency of the disciplinary proceedings.

    The Resolution read, “the resolution Looking to the gravity of misconduct of Advocate and conduct before the Hon'ble High Court, it is further resolved that during the pendency of Disciplinary Proceedings, Mr. Dharmesh Jivanial Guriar is hereby suspended as an Advocate.”

    Additionally, the Bar Council directed the Secretary of the Bar Council of Gujarat to file a compliance report before the High Court.
