Bengaluru Court Directs FIR Against Hospital Officials On Private Complaint Alleging Forgery Of Electronic Medical Records

A Bengaluru Court has directed the Bellandur police station to register an FIR against several officials of a Hospital, after a private complaint was filed by an anaesthesiologist alleging forgery of electronic medical records (EMR), criminal conspiracy, and unlawful retaliation.
The XLI Additional Chief Judicial Magistrate Court has called for a police report regarding registration of FIR following the complaint preferred by an independent consultant anaesthesiologist.
As per the court website, the case is awaiting final report from the police.
The complainant has accused six officials of Sparsh hospital including the Chief Operating Officer, Group Chief People Officer, Group Medical Director and the Head of Anaesthesiology for EMR tampering, defamation and criminal intimidation, among other infractions.
According to the complaint, in August 2025, when the complainant- anaesthesiologist was managing a patient under epidural analgesia, an inference was made by him as to the motor weakness seen in the patient's right lower limb. The private complaint states that he documented the said finding, and accordingly, recommended temporary cessation of the epidural infusion.
The complainant alleges that the Lead Consultant & Head of Anaesthesiology, thereupon, directed him through WhatsApp messages to remove the said clinical notes. When he refused, an unauthorized addendum was allegedly inserted into the patient's EMR on the same day, thereby, suppressing his original findings.
The Anaesthesiologist- complainant further states that another accused IT professional facilitated this allegedly wrongful insertion using IT access to the hospital's EMR platform. Furthermore, a 'Doctors' Daily Progress Note' on August 30 also recorded a patient review at 3.30 PM, negating the complainant's findings. This review was initiated and authorised much later at 7.31 PM. The private complaint alleges that the said authorisation was over an hour after the impugned addendum, and had left the authoring doctor's medical registration number vacant.
The private complaint alleges when the complainant- anaesthesiologist raised concerns about the veracity of medical records, he was unduly subjected to retaliatory measures such as withholding his salary and wrongful termination in October 2025, followed by a relieving order in January 2026. This was the result of the complainant not budging to the pressure tactics deployed by the COO to tender a 'scripted' apology, the complaint states further.
Following these incidents, the complainant had lodged a disciplinary complaint of professional misconduct before the Karnataka Medical Council which is currently pending.
Moreover, though he filed complaints with the Bellandur Police Station on March 28 and with the Superintendent of Police/DCP Whitefield on April 24 no action was taken so far despite the allegations disclosing cognizable offences, the petition added.
The complaint has invoked the guidelines laid down by the Supreme Court in Lalita Kumari v. State of U.P.(2013), stipulating the registration of an FIR upon receipt of information disclosing a cognizable offence.
The complaint seeks prosecution of the hospital officials under Sections 335 (Making a false document), 336 (Forgery) and 336(3) & (4) (Forgery for cheating and to harm reputation), 61(2)(a) (Criminal conspiracy), 3(5)(Common intention), 318(2) (Cheating) and 319 (Cheating by personation), and n 351 (Criminal intimidation) of Bharatiya Nyaya Sanhita, 2023 (BNS).
Additionally, the complaint mentions Sections 43, 66, and 66C of the Information Technology Act, 2000, on the counts of unauthorized access, data theft, and identity theft.
The matter is listed on October 13.
