To Reduce Burden On Bombay HC, Maha Legislative Council Clears Bill To Raise Pecuniary Jurisdiction Of City Civil Court Upto ₹10 Crore

In order to reduce the burden of cases on the Bombay High Court, soon all suits valued up to Rs. 10 crore will be heard by the Bombay City Civil Court. This is a jump from its current pecuniary jurisdiction to handle cases up to Rs. 1 crore.

The Maharashtra Legislative Council has passed an amendment to the Bombay City Civil Court Act, 1948 to try and dispose of suits and proceedings of a civil nature within Greater Mumbai valued below Rs. 10 crore. Th bill was earlier passed by the Maharashtra Legislative Assembly. The file is under process in the Governor's office.

It was only in 2012 that the pecuniary jurisdiction of the Bombay City Civil Court was increased to Rs. 1 crore.

“Over the period of more than ten years, the value of properties in Mumbai has escalated sharply. Due to sharp escalation in the value of properties, the valuation of civil suits relating to properties in Mumbai have also been increased, resulting in filing of more number of suits in the High Court instead of the Bombay City Civil Court,” Deputy Chief Minister Devendra Fadnavis said in the statements and objects of the Bill.

The amendment will result in the transfer of over 8,672 civil suits pending before the Bombay High Court, to the Bombay City Civil court.

A notification in the official gazette will be published in due course, amending Section 3 of the said Act.
