Bombay High Court To Hear Actor Suniel Shetty's Plea For Quashing Criminal Trespass Complaint By International Cuisines Restaurant Next Month

Actor Suniel Shetty has approached the Bombay High Court to quash a case of mischief, and wrongful restraint against him in a 2013 dispute regarding his father's property in Girgaon, Mumbai.The complainant, "International Cuisines" claimed that they were Shetty's father's tenants and illegally thrown out of the premises by Suniel Shetty and five others on May 30, 2013.The cash counter was also looted, the complaint said.In 2021, the DCB CID chargesheeted Shetty under sections 341 (wrongful restraint), 427 (mischief causing damage upward of Rs. 50,000), 448 (house trespass), 201 (destruction of evidence), and 114 (abettor present when offence is committed) under the Indian Penal Code.Shetty then filed the quashing petition under section 482 of the CrPC the same year.Today, a division bench of Justices Nitin Jamdar and NR Borkar granted limited relief to Shetty. The High Court asked the trial court to grant Shetty an adjournment if he filed an application and directed for the matter to be listed after three weeks.Advocate AK Singh for the complainant sought an adjournment as he hadn't received a copy of the petition.While Shetty has sought quashing of proceeding against him, the complainant has also approached the High Court in another writ petition seeking charges of dacoity and criminal intimidation to be added. The sections were dropped by the DCB CID when the chargesheet was filed.According to the complainant, Shetty's father Veerappa had leased his hotel to the complainant who had deposited security of Rs. 21 lakh and subsequently spent Rs. 4 crore on renovating it.The complainant started the franchise of Little Italy, which was doing good business till the time Shetty entered the premises in 2013. While the VP Road police refused to register an FIR, the complainant approached the magistrate's court that ordered an FIR to be registered on 2014.The investigation was subsequently transferred to the DCB CID. The complainant's petition seeking addition of charges states that the accused are using his furniture and other appliances of over Rs. 2 crore till date.Shetty's quashing petition will be taken up after three weeks.
