    A Delhi Court has granted bail to former Maharashtra Home Minister Anil Deshmukh's lawyer, Anand Daga in connection with the allegations of leaking sensitive documents in the ongoing investigation against former Maharashtra Home Minister Anil Deshmukh, thereby subverting investigation.

    Special Judge Sanjeev Aggarwal also granted bail to Vaibhav Gajendra Tumane, Co accused in the matter.

    "Further, A-2 is stated to be an Advocate and A-3 is stated to be related to Media, therefore, both of them can be said to have roots in the society. Further, the allegations of the present case does not pertain to economic offences of huge magnitude, therefore, it cannot perse be said to be falling under the category of grave offences," the Court said.

    Bail has been granted to both the accused subject to their furnishing of personal bonds in the sum of Rs.1,00,000 each with one surety of the like amount.

    While Daga was denied bail by the Delhi High Court in the matter, the Court was of the view that there were fresh grounds qua Daga after the dismissal and also the fact that he was in judicial custody for almost five months.

    "Therefore this subsequent/successive application moved by A- 2 after the dismissal of his earlier bail application(s), on the ground mentioned above, is based upon materially different grounds, as charge- sheet in this case has already been filed after thorough investigations after a lapse of 90 days, whereafter the matter is now pending at the stage of inquiry/further investigations," the Special Judge noted.

    CBI had arrested Daga and Tiwari from Mumbai and Delhi respectively. After being produced before a Magistrate's Court in Mumbai, transit remand was given for Daga thereby directing his production before a Delhi Court.

    Accordingly, Daga and Tiwari were both produced before the Special CBI Judge of the Rouse Avenue Court. Their bail application was rejected by Special CBI Judge Vimal Kumar Yadav thereafter.

    The FIR was registered against Daga, Tiwari and unknown others alleging that they entered into a criminal conspiracy for the purpose of disclosing the case sensitive and confidential documents to Anand Daga in lieu of undue advantage and illegal gratification.

    The said FIR has been registered under sec. 120B of IPC and sec. 7 and 8 of Prevention of Corruption Act.

    Anand Daga was represented by Advocates Tanveer Ahmed Mir, Vaibhav Suri and Kartik Venu.
