The Delhi High Court on Thursday sought CBI's response in the bail plea filed by Sub Inspector Abhishek Tiwari in connection with the allegations of leaking sensitive documents in the ongoing investigation against former Maharashtra Home Minister Anil Deshmukh, thereby subverting investigation.

Justice Yogesh Khanna issued notice on the bail application filed by Tiwari through Advocates Meenesh Dubey and Abdhesh Chaudhary.

The plea states that the FIR has been registered against him on the basis of surmises and conjectures and that he has been entangled in the matter because of a "conspiracy of victimization hatched by some seniors, who always had an eye on his integrity, honesty and uprightness" in performing his duty as an Investigator for CBI.

The FIR was registered against Daga, Tiwari and unknown others alleging that they entered into a criminal conspiracy for the purpose of disclosing the case sensitive and confidential documents to Anand Daga in lieu of undue advantage and illegal gratification.

The said FIR has been registered under sec. 120B of IPC and sec. 7 and 8 of Prevention of Corruption Act.

"Basically, the present case is a rivalry between the senior officers, wherein the Petitioner has been made a scape-goat for obvious reasons that the being lower in rank did not toe with the whims and fancies of certain senior officers relating to the manner of Investigation," the plea reads.

The development came after Tiwari's bail application was rejected by Special CBI Judge Vimal Kumar Yadav last week.

The Court had sent Daga and Sub-Inspector Abhishek Tiwari to 14 days judicial custody while dismissing the application moved by CBI seeking further police remand for five days.

"In these circumstances, when the accused persons have remained in CBI custody for 4 days, there appears no reason to further extend their CBI custody as nothing new showing the nature of data extracted and the confrontation of the same is before the Court. Application stands declined," the Court ordered while sending the two to judicial custody.

The Court further directed the duo to be produced next on September 20, on the expiry of their judicial custody.

The Court had earlier extended their CBI custody by two days after the agency had sought 7 days additional custody remand for them.

CBI had arrested Daga and Tiwari from Mumbai and Delhi respectively. After being produced before a Magistrate's Court in Mumbai, transit remand was given for Daga thereby directing his production before a Delhi Court.

Accordingly, Daga and Tiwari were both produced before the Special CBI Judge of the Rouse Avenue Court.
