    The Delhi High Court today observed that it cannot pass an order permitting physical meeting of a father with his minor son, who is living with his estranged wife, unless the former is fully vaccinated.

    The observation was made by Justice Rekha Palli while denying an oral request made by the father of a four year old, seeking permission to bring his son home on the occasion of Janmashtami.

    The Court was hearing an appeal filed by the child's mother, challenging an order of the family Court granting 40 minutes custody per day to the father. During pandemic however, physical visitations were converted to virtual.

    During the course of hearing, the Respondent father made an appeal before the High Court to allow only one day's physical custody on the occasion of Janmashtami.

    Initially, the Court expressed inclination to allow the request. However, on being apprised that the Respondent has been administered only the first dose of Covid-19 vaccine, the Court refused any relief.

    "I cannot allow you to meet the child unless you are fully vaccinated," the Judge remarked.

    The Petitioner insisted that full-vaccination is not a guarantee against contracting the infection. However, the Court made it clear, "That's the protocol we are following."

    The matter has now been posted for (hybrid) hearing on the main issue 8th September.
