    The Bombay Bar Association passed a resolution on Monday to deprecate the "false" and "baseless" complaint letter against Justice DY Chandrachud, second senior-most judge of the Supreme Court of India, and called the letter a "scandalous attack" on the judiciary.

    BBA expressed "full faith and trust" in Justice DY Chandrachud and the "independent and impartial justice dispensation by him."

    The Association sought strict action against one RK Pathan, who allegedly drafted the 165-page complaint against Justice Chandrachud and his son Abhinav Chandrachud accusing them of judicial indiscipline. Pathan claimed he headed the so called "Supreme Court and High Court Litigant Association."

    Pathan's complaint was widely circulated on social media, on Saturday.

    According to the resolution, Pathan is the same person who was convicted of Contempt of Court by the Supreme Court of India and sentenced to imprisonment for three months following allegations against a sitting SC judge.

    According to BBA, the present complaint is nothing but a similar act on the part of Pathan just before the recommendation of Justice Chandrachud's name as the next Chief Justice of India. "The malicious intent and purpose behind such a complaint is not far to see and is exposed by the timing of the complaint itself."

    Even earlier BBA approached the HC against Pathan for making false accusations against a sitting Bombay HC judge based on which he was issued a show cause notice.

    Dealing with specific allegations that Justice Chandrachud passed an order in a matter which it is allegedly connected to a matter where Dr. Abhinav Chandrachud appeared, the BBA clarified that he handles on counsel briefs and doesn't interact even with clients.

    "There is nothing on the record to demonstrate any connection," the resolution states, adding, that it was "inconceivable" Justice Chandrachud would know about every matter in which his son appeared.

    Moreover, the order passed by Justice Chandrachud wasn't even on merits. "It is merely a request to the Bombay High Court to hear either the IA or the petition since a grievance was made that neither of them are being taken up. The allegations made by the Complainant is entirely false and baseless and clearly a malicious attempt to malign the Judge and also the judiciary as a whole."

    Finally, the BBA resolved and strongly deprecated the "vicious attempts" to scandalise the judiciary

    Resolution

    1. RESOLVED THAT The Bombay Bar Association notes with serious concern and deprecates the attempt made by R.K Pathan by filing complaint dated 5th October 2022 making false allegations against Hon'ble Mr. Justice D.Y Chandrachud by tarnishing his blemishless image. This association reposes full faith and confidence in Hon'ble Mr. Justice D.Y Chandrachud.

    And

    1. The Bombay Bar Association to forward the resolution to Hon'ble President of India, The Hon'ble Prime Minister of India, The Hon'ble Chief Justice of India, the Central Vigilance Commission and others as may be decided by the President and the Secretary of the Bombay Bar Association with a request, not to take any cognizance of the complaint and instead initiate strict action against Mr R. K. Pathan, and all those associated with him.

    Justice Chandrachud was a former judge at the Bombay High and his son Abhinav is a member of the BBA.

    The Bar Council of India, Supreme Court Bar Association, Oudh Bar Association and the Tamil Nadu Advocates Association have passed resolutions supporting Justice Chandrachud and condemning the attempts to vilify his image ahead of his imminent appointment as the next CJI.
