Ghaziabad Court Violence | Allahabad HC Bar Association Resolves To File Criminal Contempt Case Against District & Sessions Judge

Condemning the recent lathi charge violence against advocates in Ghaziabad Court, allegedly at the behest of the District and Sessions Judge, the Allahabad High Court Bar Association today passed a resolution deciding to file a criminal contempt case against the Judicial Officer (Judge Anil Kumar-X). In its resolution, the Allahabad HCBA also decided to abstain from judicial work on November 4 to protest the 'unjustified' violence unleashed against the advocates in Ghaziabad. The association has also stated that the District and Sessions Judge and the concerned police officers should be dismissed from service immediately and that compensation should be provided to the injured advocates without delay. The executive committee of the HC Bar Association has also resolved to state that the High Court should take such concrete steps so that such incidents do not occur again in any other district court. The resolution adds that during the hearing of criminal contempt reference at the High Court, the advocates are prevented from presenting their case and are coerced into seeking unconditional apology in the courtroom, often accompanied by police brutality. The resolution was passed today in an emergency meeting of the Executive Committee of the High Court Bar Association, Allahabad, chaired by President Anil Tiwari, Senior Advocate, and conducted by General Secretary Advocate Vikrant Pandey, Advocate. The executive committee expressed deep concern over the current scenario, stating that the courts are harassing the advocates on multiple fronts. The resolution states that if an advocate raises objections against a judicial officer's 'wrongful' actions, the officer quickly refers the matter to the High Court for criminal contempt. Further, the Advocates face additional harassment, and if they choose to strike in protest against the arbitrary actions of such judicial officers, they are threatened with contempt proceedings. “Overall, it is becoming increasingly clear that advocates are losing their right to express themselves in any manner. This situation is intolerable and will not be accepted under any circumstances,” the resolution further states. The committee has also demanded that if the High Court constitutes a high-level fact-finding committee to probe the matter, the representation of the advocate proposed and nominated by the High Court Bar Association Allahabad would also be necessary; otherwise, the report submitted will be unacceptable. The meeting was attended by Rajesh Khare (Senior Vice President), Agnihotri Kumar Tripathi, Akhilesh Kumar Mishra, Subhash Chandra Yadav, Neeraj Tripathi, Neelam Shukla (Vice Presidents), Sumit Kumar Srivastava (Joint Secretary Administration). Abhijeet Kumar Pandey (Joint Secretary Library), Puneet Kumar Shukla (Joint Secretary Press), Aanchal Ojha (Joint Secretary Women), Ran Vijay Singh (Treasurer), Abhishek Mishra, Awadhesh Kumar Mishra, Abhishek Tiwari, Rajesh Shukla, Ved Prakash Ojha, Amarnath Tripathi and Brajesh Kumar Singh Sengar.
