The Managing Committee of the Gujarat High Court Advocates' Association has written to the Chief Justice, highlighting several difficulties being faced by the Advocates in the present mode of functioning.

    They informed the Court that:

    • Matters mentioned before the Court are many a times not listed notwithstanding, even after the Court having ordered to be listed on a particular day.
    • Helpline numbers for Advocates' assistance are not being attended to.
    • After the matter is filed, Registry for the very same matter, raises different set of office objections more than once. It also often raises several unnecessary objections.
    • Sometimes the registry takes much more time, than should be required, in raising the objections.

The Association has urged the Court that:

    • The practise of Filing through mail be restored till physical functioning of the courts starts, as the present system of filing, through e-portal, is very tedious.
    • The filing of a Vakalatnama by an advocate seeking his appointment as replacement of another Advocate along with the No objection of the former advocate Vakalatnama be accepted by way of E-filing.
    • Meeting link be sent to all such advocates who are desirous of mentioning their matters.
    • The Registry be directed to raise the all the objections at once and not in a phased manner.
    • Registry be directed to raise the objections in a week's time of the filing of the matter.
    • The Registry be directed to acknowledge the physical filing.
    • Registry be directed to place all the papers filed in the matter, before the Court before the circulation of the matter.

Note: The Gujarat High Court has appointed a Committee, consisting of Justices Sonia Gokani, AJ Desai and NV Anjaria, to discuss the issues with the office bearers of the Bar. The Association has urged that the letter be referred to this Committee for quick deliberation.
