    The Supreme Court has extended the stay of the order of the Delhi High Court denying further extension of interim bails granted to undertrials, till the next the date of hearing.

    A bench comprising of Justice L. Nageswara Rao, Justice Hemant Gupta and Justice Ajay Rastogi posted the case for hearing on 21st January 2021.

    On October 20, 2020, the Delhi High Court had observed that there shall be no extension of interim bails granted to undertrials involved in heinous crimes. It had directed that, for 2318 undertrials involved in heinous crimes, who were granted interim bail by the District Courts, there shall be no further extension of interim bails under the orders of this Court. (Schedule for surrender in phased manner has been prescribed). 356 prisoners granted interim bail by the High Court, were directed to surrender before the concerned jail superintendent(s) on 13th November, 2020.

    A special leave petition was filed against this by the National Forum On Prison Reform. On October 29th, the Apex Court Court had ordered that the above directions, contained at point no. (i), (ii) and (iv) of para 7 of the High court order shall be stayed until the next date of hearing.
