Kerala Court Issues Bailable Warrant Against Patanjali Ayurved's Baba Ramdev And Managing Director In Misleading Advertisements Case

A Kerala Court has issued bailable warrant against Divya Pharmacy and its co-founder Baba Ramdev and its Managing Director Acharya Balkrishna in a case of publishing misleading advertisements in English and Malayalam newspapers.The bailable warrant is issued on Janauary 16 by Judicial First Class Magistrate Court II, Palakkad. The next date is February 1, 2025.Divya Pharmacy is an affiliated company of Patanjali Ayurved.The complaint was taken based on the report of Drug Inspector under Section 3, 3 (b) and 3 (d) of The Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954. Section 3 prohibits the advertisement of certain drugs for the treatment of certain diseases and disorders. Section 3 (b) prohibits advertisements of drugs claiming maintenance or improvement of the capacity of human beings for sexual pleasure. Section 3 (d) prohibits advertisements of drugs that claim the diagnosis, cure, mitigation, treatment or prevention of any disease, disorder or condition of diseases provided in the Rules made under the Act.Divya Pharmacy is the first accused, Acharya Balkrishna the second accused and Baba Ramdev the third accused in the case.Similar case in pending in Kozhikode district also. The warrant was issued after the Supreme Court warned states and union territories that it will initiate contempt proceedings on failure to take action against misleading advertisements and medical claims that run contrary to law. The Apex Court was hearing a petition filed by the Indian Medical Association (IMA) regarding misleading claims and advertisements targeting modern or “allopathic” medicine.Patanjali Ayurved products were under the scrutiny of the Supreme Court for publishing misleading advertisements against modern systems of medicines like Allopathy. The Court later issued a contempt notice to Patanjali Ayurved for continuing to publish such misleading advertisements that disparage allopathy and make false claims about curing certain diseases. The contempt cases were later closed by the Supreme Court accepting the public apology issued by Ramdev, Acharya Balkrishna and Patanjali Ayurved.Case : Drugs Inspector Palakkad v.
