    The District and Sessions Court Thiruvananthapuram on Wednesday (December 10) granted anticipatory bail to Palakkad MLA Rahul Mamkootathil in the second rape case alleged against him.

    Mamkootathil is accused of the offence under Section 376 of the Indian Penal Code before the Crime Branch police station. The victim is alleged to be residing outside Kerala.

    Smt. Nazeera S., Principal District and Sessions Judge, pronounced the order today.

    A detailed order is awaited.

    The prosecution allegation was that in 2023, Mamkootathil got the victim's number on Telegram app and contacted her, giving false assurances of marrying her. Further, it is alleged that Mamkootathil asked her to meet him privately and took her to a homestay-like building on the pretext of discussing their future plans. The allegation is that he assaulted and raped her there, despite clear resistance from her side.

    It is stated that the victim sent an email complaining against Mamkootathil to the Kerala Pradesh Congress Committee and the same was forwarded to the State Police Chief. The complaint was then forwarded to the Crime Branch and led to the registration of the present case.

    In his bail plea, Mamkootathil has submitted that there has been a delay of 2 years in preferring the complaint and the victim has not given a proper complaint before the authorities.

    The plea further states that the allegation is baseless and does not attract any offence.

    "It is further submitted that the email doesn't give any information about the victim, or the information about the date of occurrence, place of occurrence and even no one has the idea whether the complainant is a girl or not," states the plea.

    After a detailed hearing on Monday, the Court had reserved the case to pronounce its judgment today.

    His earlier pre-arrest bail plea in another rape and miscarriage case was rejected by the Sessions Court, which led him to move the High Court seeking anticipatory bail. The High Court will consider the case on December 15 (Monday) and he has been granted interim protection from arrest till then.
