The wife of late Jayabalakrishnan, the victim of the recent fatal accident that occurred in Cheranaloor (Kochi), has moved the Sessions Court to implead herself in State's plea seeking cancellation of the bail granted to the minor accused.
On Monday, the Juvenile Justice Board, Ernakulam had granted bail to the 17-year-old, who had allegedly driven the Mercedes Benz car that hit the victim's scooter. The State had moved for bail cancellation on the same day.
When the State's plea came up today (October 28), Smt. Kavitha Gangadharan, Addl. District Judge, called for the case records from the JJB and issued notice to the minor/Child in Conflict with Law (CCL).
The case stands posted to October 30 (Friday) for consideration. The impleading petition will also be considered on the same day.
According to the FIR registered by the Cheranalloor Police, the car rammed into the scooter ridden by a 55-year-old street food vendor at around 2:00 am on Sunday (October 25) while he was returning home. The police had registered the case under Sections 281 [Rash driving or riding on a public way], 106(1) [Causing death by negligence] of the Bharatiya Nyaya Sanhita, 2023.
The minor/CCL is the son of a District Judge. The judge, who is the registered owner of the Mercedes-Benz, was also recently arrayed as an accused. He has been booked under Section 199A of the Motor Vehicles Act [Offences by juveniles].
