    State General Secretary of the Kerala State Indian Youth Congress Advocate Abid Ali has moved a private complaint before the Chief Judicial Magistrate, Ernakulam against the director and the producer of the newly released film 'The Kerala Story 2 - Goes Beyond'.

    Chief Judicial Magistrate Smt. Selmath R. M. on Thursday (March 5) heard the complainant and perused the private complaint. A copy of the complaint was directed to be served to the Station House Officer of Aluva Cyber Police Station.

    It is alleged that the moviemakers committed offences punishable under Sections 196 [Promoting enmity between different groups on grounds of religion, race, place of birth, residence, language, etc., and doing acts prejudicial to maintenance of harmony] and 299 [Deliberate and malicious acts, intended to outrage religious feelings of any class by insulting its religion or religious belief] of the Bharatiya Nyaya Sanhita.

    The complainant has alleged that the filmmakers released a teaser and a trailer of the film through the social media accounts of Sunshine Pictures and Sunshine Music and the same contain offending materials. It is further alleged that the trailer and the teaser, which were not certified by the Censor Board, portray a false propaganda that massive religious conversions of Hindu girls are happening in Kerala at the instance of Muslims.

    According to the complainant, these videos are creating polarisation in the country by causing fear among the Hindu community and by promoting hatred against the Muslim community. He has also pointed out that the videos are circulated with a tagline 'Inspired by true events' with the sole intention for the same.

    The complainant has also stated that the videos allegedly portray that Muslim youths pretend to love girls from other religions and thereafter, forcefully coverts them and isolate them from their families. It is also alleged that the teaser claims that the objective of these Muslim youths is to marry and convert 85 million unmarried Hindu girls in India and to convert India into an Islamic nation.

    In the complainant drafted in Malayalam, he has cited certain dialogues made by Muslim priests in the videos that roughly translates to 'Insha Allah, within the next 25 years India will become an Islamic nation and Sharia law will be implemented throughout the country', 'Our job is to convert Hindu girls' and 'Before your daughter becomes the next target…', etc.

    These dialogues, according to the complainant, are placed on purpose by the movie makers as a call upon the Hindu community to protest against the Muslim community.

    The complainant has also mentioned the status of the other proceedings pending in the State against the movie. Three separate complaints were made on three consecutive days since the release of the videos before the Aluva Rural Cyber Police Station, the Ernakulam District Police Chief and the State Police Chief but no FIR has yet been registered.

    The movie as well as its prequel 'The Kerala Story' has been the subject of much litigation. Initially, three separate pleas were moved before the High Court challenging the censor certification of the 'Kerala Story 2'. While one of those pleas got dismissed for want of sufficient pleadings supporting locus, a common interim order was passed by the Single Bench in the other two pleas, granting a stay on the release of the movie.

    The Single Bench's order got challenged before the Division Bench on the very same day and, the next day, an interim order lifting stay and permitting release on the scheduled date was passed. Later, another plea was moved before a Division Bench considering public interest litigations. On Thursday, the Bench had refused to entertain the PIL and gave liberty to the petitioners to move a fresh plea removing certain pleadings.

    The next posting of the Criminal Miscellaneous Petition is on March 9 (Monday).
