    Additional Public Prosecutor P Narayanan along with the DGP has penned a letter to the Registrar General of Kerala High Court accusing a counsel of the Court of forging a case status.

    According to the letter, an accused charged under Section 308 IPC (attempt to commit culpable homicide) had approached the Court seeking anticipatory bail. The accused is reportedly a lawyer himself who was booked for attempting to murder his wife. 

    The Court considered the application, asked the Public Prosecutor to get instructions and posted it for further consideration in February 2022. 

    Meanwhile, since the offence alleged against the accused was of grave nature,  the accused was apprehended by the Inspector of Police. 

    On the same day of the arrest, the counsel of the accused approached the Station House Officer alleging that there was an interim order passed by the Court prohibiting coercive steps in the matter and thereby requested that the accused be released.

    The Counsel also forwarded a printout of the case status from the High Court website to the SHO via WhatsApp. 

    Given below is the relevant portion of the said printout where it appears that the Court passed an interim order: 


    However, since the Government Pleader had not communicated anything of that effect to the SHO, he verified the case status from the official website of the High Court. 

    It was found that no interim order was issued in the matter preventing the arrest of the accused.

    It is alleged that upon enquiry through the Registry, it was confirmed that no such interim order had been issued by the High Court in the said bail application. 

    Therefore, the ADGP pointed out that there was some malpractice committed in the printout produced before the police by the counsel and alleged that it was a forged copy. 

    In such circumstances, the letter sought that appropriate action be initiated in the matter.
