    The Madhya Pradesh High Court, Gwalior Bench recently sought for personal presence of the General Secretary of the Arya Samaj Vivah Mandir Trust to explain to the Court regarding the codified/customary law under which the said institution can convert the religion of a person.

    Hearing the writ petition filed in the nature of habeas corpus, division bench of Justice Rohit Arya and Justice M.R. Phadke raised the query-

    On a pointed query to learned counsel for respondent No.6 as to under which provision of codified law or customary law Arya Samaj Vivah Mandir which in fact is an Arya Samaj Marriage Bureau can convert the religion of a person, learned counsel is at loss to state that he is not aware of the same. Instead, he tried to submit that once a notarized agreement is submitted before the Arya Samaj Vivah Mandir there is no reason to doubt about the conversion and therefore marriage is solemnized.

    The Court noted that the submission made in response to its query was based on 'miserably misconceived notion' for which there was no foundation of law. Accordingly, the Court directed the General Secretary of the Institution to remain personally present on the next date of hearing.

    The facts of the case were that the Petitioner, a Hindu Man, was allowed to solemnize marriage with a Muslim woman, purportedly upon her conversion at Arya Samaj Vivah Mandir.

    Earlier, the Court, vide order dated 18.01.2022, had rejected the prayer of the Petitioner to withdraw the case, observing that it was a 'serious matter'.

    The matter is listed on 02.05.2022.
