Drugs Case : Magistrate Court Grants Bail To Bharti Singh & Husband Harsh Limbachiya

While Bharti Singh was summoned for questioning at NCB's office on Saturday and was arrested the same day, her husband was arrested the next day and the couple were sent to judicial custody till December 4 by the same court on Sunday. NCB has claimed that both the accused have confessed to consumption of marijuana. Right after the couple was sent to judicial custody, they filed bail applications seeking to be released.

Moreover, Bharti Singh and Harsh Limbachiya have been booked under Sections 20(b)(ii)(A) 8(c) and 27 of the NDPS Act.

During the hearing before the Magistrate on Saturday, NCB sought Harsh Limbachiya's custody but did not seek Bharti Singh's custody. It was submitted on behalf of the NCB that Bharti may be sent to judicial custody.

Appearing on behalf of the couple, Advocate Ayaz Khan argued that the need for custodial interrogation of the accused did not arise as the contraband substance recovered is less than the 'commercial quantity' as prescribed under the Narcotic Drugs and Psychotropic Substances Act.

A total of 1 kilogram of Ganja is considered a "small quantity" as per the NDPS Act whereas 20 kilogram is commercial quantity.

Court accepted Khan's submissions and observed that the accused have been questioned at length on Saturday itself by the NCB.

The couple's house was raided by the NCB after a drug peddler who was arrested in relation to the Sushant Singh Rajput death case, named Bharti.

Today, both Bharti and Harsh were granted bail on a PR bond of Rs.15,000 each.
