Arguments in the bail application of Anand Giri, the prime accused in the alleged suicidal death of Mahant Narendra Giri could not take place today as the CBI's counsel wasn't available and therefore, the matter was adjourned to January 31.

Giri has been booked for allegedly abetting the suicide of Mahant Narendra Giri, the President of Akhil Bhartiya Akhara Parishad and the matter is currently being probed by the CBI. Anand Giri is presently under custody and has moved the HC with his bail plea.

The case was adjourned on a request made by the Central Bureau of Investigation, which is currently probing the matter, on account of the unavailability of its lead counsel due to his illness.

Acceding to the request made by the CBI, the Bench of Justice Rajiv Gupta has now been listed for further hearing on January 31.

However, his counsel, Senior Advocate Gopal Das Chaturvedi said before the Court that the matter is repeatedly being adjourned even though the case related to Abetment to Suicide wherein nothing much needs to be argued.

"The matter is lingering on, it has already been greatly delayed even when there is no evidence of abetment, just a suicide note and still my client has spent enough time in the jail," he further added as he argued before the Court, that since CBI is being represented by a counsel, though not the lead counsel, the matter be heard.

However, later on, he agreed to Court's decision to adjourn the matter. The Court told the CBI's counsel that no further adjournment shall be given.

It may be noted that on the last two occasions as well, i.e., January 18th and January 5th, the matter had to be adjourned.

While on Jan 18, the matter was adjourned due to technical glitch as Giri's counsel was not audible to the court, on Jan 5th, the court was informed by the CBI that though it had filed its reply on Giri's plea, but the same couldn't be placed before the Court.

    About the case

Mahant Narendra Giri (72), was found dead inside his room at the Baghambari Math in UP's Pyayagraj on Monday (September 20), and the names of the accused Giri and Tiwari had surfaced in an alleged suicide note which is said to have been written by the Hindu saint shortly before he allegedly died by suicide.

The letter, allegedly written by Mahant Narendra Giri stated that he feared that Anand Giri would circulate a morphed photo of him with a woman to defame him and that it won't be possible for him to give an explanation. He had also expressed that he was deeply disturbed by Anand Giri's false allegations of financial irregularities against him.

The FIR registered against Anand Giri (booking him under Section 306 of IPC) states that Mahant Narendra himself used to say that he is being troubled by Anand Giri. Giri is currently under judicial custody by a Prayagraj court in connection with the death of Mahant Narendra Giri.
