A Delhi court has allowed seven foreign nationals arrested in a UAPA case being probed by the National Investigation Agency (NIA) to travel to their home countries in the United States and Ukraine, noting that right to travel abroad is an extension of fundamental rights.

Special NIA Judge Prashant Sharma noted that the court had earlier discharged six Ukrainian citizens under Section 21 and 23 of the Immigration and Foreigners Act, 2025, and the US national Matthew Aaron Van Dyke was discharged on September 18 and 25 respectively.

The NIA had arrested them in a case allegedly involving a drone-warfare training camp linked to ethnic armed groups in Myanmar.

They were allowed to travel their home countries after they were granted default bail earlier this month. Now, they have been permitted to leave the country, subject to conditions.

NIA had initially filed its first chargesheet on September 08 without invoking provisions of the Unlawful Activities (Prevention) Act (UAPA), although the agency said its probe into alleged terror funding offences was continuing.

The agency had obtained an extension to investigate the alleged UAPA offences for 180 days.

The accused were allegedly involved in training concerning drone warfare, drone operations, assembly and jamming technology for Myanmar-based Ethnic Armed Groups.
