Nikita Tomar Murder Case: Faridabad Court Convicts Two, Arguments on Sentence on 26th March

A Sessions Court in Faridabad on Wednesday convicted the key accused Tausif and his friend Reehan in connection with the Nikita Tomar murder case after having found them guilty of murder, kidnapping or abduction in order to murder, common intention, criminal conspiracy and other relevant provisions of the IPC. However, the Court acquitted the third accused namely Arjudeen who had supplied the weapon which killed the deceased. The verdict was delivered by Additional Sessions Judge Sartaj Baswana four months after the trial commenced in December last year. Arguments on the quantum of sentence will be heard by the Court on 26th March 2021. Nikita Tomar, a 20 year old B.Com. final year student, was shot dead in broad daylight on October 26, 2020 by her schoolmate in Faridabad's Ballabgarh in Haryana. Nikita was shot by Tousif, in the presence of his friend Reehan, an incident which was recorded in the CCTV present in the area. The footage showed the two trying to force Nikita to enter their car while she was coming out from Aggarwal College after writing an exam. The FIR was registered under sec. 302 (punishment for murder), 364 (kidnapping or abducting in order to murder), 366 (kidnapping, abducting or inducing woman to compel her marriage), 34 (common intention) and 120B (criminal conspiracy) of Indian Penal Code and sec. 25(1), 54 and 59 of Arms Act.A Special Investigating Team (SIT) was constituted on 27th October led by Anil Kumar Yadav, ACP (crime) for probing into the matter followed by which a chargesheet running into 700 pages was filed by the SIT. The said chargesheet was based on scientific and forensic evidences, CCTV footage, call detail records, location details and gunpowder swabs collected from the suspect's hand. The charges were framed by the Court on 23rd November last year and the trial finally commenced from 1st December.
