    The Allahabad High Court recently granted bail to 3 persons accused of raised slogans against Uttar Pradesh Chief Minister and burning his effigy.

    All the accused have been booked for sedition and thus they contended before the Court that they took part in a political protest and that the ingredients of the offence under Section 124A I.P.C. are not made out.

    The Bench of Justice Suneet Kumar granted bail to Phoolchandra Yadav, Aashutosh Agrahari and Suraj Singh, booked under Sections 147, 188, 269, 341, 124A I.P.C, Section 66 I.T. Act and Section 6 of United Provinces Special Power Act, 1932.

    They have been directed to be released on bail on their furnishing personal bonds with two sureties each in the like amount to the satisfaction of the court.

    As per the prosecution case, 12 nominated and 10-12 unknown persons are said to have raised slogans against the Chief Minister and burnt his effigy.

    Applicants before the Court were named in the F.I.R and it is urged by counsel for the applicants that six co-accused in the similar circumstances have been enlarged on bail.

    It was further submitted that the applicants are languishing in jail since 17.03.2021 and that there is no likelihood of early disposal of trial and the applicants undertake that if enlarged on bail, they will never misuse liberty and will cooperate in the trial.

    Without expressing any opinion on the merits of the case and considering the nature of the accusation and the severity of punishment in case of conviction and the nature of supporting evidence, reasonable apprehension of tampering of the witnesses and prima facie satisfaction of the Court in support of the charge, the applicants were found to entitled to be released on bail in the case.

    The Allahabad High Court recently stayed the arrest of a retired IAS officer who has been booked under various offences under Section 505 IPC and Section 66 of the IT Act for tweeting an audio clip containing a conversation alleging that people were being paid to tweet in favour of Yogi Adityanath.

    The Bench of Justice Pritinker Diwaker and Justice Samit Gopal stayed Ex-IAS Officer Surya Pratap Singh's arrest till the next date of hearing and posted the matter in the week commencing August 9, 2021.

    In June 2021, last month, he was granted a stay on his arrest in another FIR for various offences under IPC, Uttar Pradesh Public Health and Epidemic Diseases Control Act, 2000, Disaster Management Act, 2005 and IT Act for allegedly tweeting some photos and videos alleging COVID mismanagement in Uttar Pradesh with regard to COVID Dead Bodies.

    Earlier this year, the Allahabad High Court granted bail to a Truck Driver named Amar Pal Yadav who allegedly sent a WhatsApp message threatening to kill Uttar Pradesh Chief Minister Yogi Adityanath if gangster Mukhtar Ansari was not released within 24 hours.

    The Bench of Justice Dinesh Kumar Singh was hearing the bail application filed by the applicant in Crime/FIR No.0280 of 2020, under Sections 124A, 501, 504, 505(1)(B), and 506 IPC and 67 Information Technology Act.

    Last year, the Allahabad High Court had granted bail to a 25-year-old youth named Kamran Ameen Khan who allegedly sent a WhatsApp message threatening to kill UP chief minister Yogi Adityanath with a bomb.
