A Delhi Court has called for an Impact Assessment Report in the plea by Unnao Rape Survivor who has moved a Delhi Court alleging harassment by the Personal Security Officers deputed as per the directions of the Apex Court for granting her adequate protection.

The plea therefore sought directions to concerned police officers of the security for not harassing or humiliating her by way of allegedly curtailing her movements or liberties without any reason.

District and Sessions Judge Dharmesh Sharma has directed the IO of Central Bureau of Investigation (CBI) to submit the report with the assistance of local police in the matter.

The plea alleged that the complainant and her family members were harassed by the Personal Security Officers for allegedly not allowing her to enjoy her liberties.

"It is directed that this application be taken up for consideration." The Court said.

According to the application, it has been stated that the victim is not able to pursue her case effectively in a democratic way, in terms of her fundamental rights guaranteed under the Constitution against the accused persons, who are allegedly hell bent upon ruining the life of her family members.

"In view of foregoing, it is most respectfully be prayed that, appropriate directions may kindly be issued to the concerned security officials not to curtail movement/ liberties of the victim/ prosecutrix on frivolous grounds and, consequently, she may be allowed her movements, upon telephonic verification of the fact from her counsel or any other source." The plea has prayed.

In a similar development, the same judge had ruled out foul play and conspiracy in the 2019 Unnao rape survivor car accident case thereby refusing to take cognizance against former BJP MLA Kuldeep Singh Sengar in the case.

The Court upheld the CBI investigation which ruled out foul play in the Unnao rape survivor car accident case. The judge prima facie noted that all the relevant aspects of the incident were thoroughly inquired, scanned, and investigated by the CBI.

The case case arose from an alleged conspiracy between Sengar and his aides; a collision took place between a truck and a vehicle boarded by the Unnao Rape survivor, her counsel, and two aunts.

Her two aunts were killed on the spot, while the victim and her counsel sustained grievous injuries. Thereby, the Uttar Pradesh police registered a case of murder against Sengar and his aides. The CBI Investigation discarded the possibility of any existing criminal conspiracy to commit murder or attempt to murder the victim and her family members.
