Justice Kaul: You are saying you should be allowed to practise even if you don't clear the exam? How will you clear the pre-enrolment exam either?

Justice Kaul, summarising: The question is, after the state power was established, was the BCI's power also taken away? There are problems with both pre and post-enrolment exams. We are trying to also fine-tune post-enrolment exams which exist today.

Counsel: My submission is that from 1961, no act, report has mentioned anything about post-enrolment exam.

Justice Kaul: Will you go practice in some district? But lawyers are needed there. There are varying degrees of proficiency...not saying that if you get 60, you will practise there, and if you get 70, you will practise here. But a basic benchmark...

Seth: If the job of BCI, which is the legal education, is carried out properly. There will never arise a question of conducting exam.

Justice Kaul: You have 1700 law schools. Do you want to shut down 1000 of them?
