Court dictates order: AG undertakes to maintain law and order situation in the area.

Interim Stay application has not been allowed today. Mosque Committee asked to amend their appeal by February 6.

Justice RRA (to AG): Please control the law and order situation there. No mishap should happen.

    • 2 Feb 2024 7:41 AM GMT

Jain: They haven't challenged 17th order, which was executed on 23.

Justice RRA: Mr Naqvi, the possession was taken and you didn't object.

      Naqvi: The puja has begun.

Justice Rra: What about the door?

Naqvi: CRPF personnel were maintaining that area. Nobody was allowed there

Jain: There was no door to the cellar.

Justice RRA: Who took control of the cellar on 23/24th

Jain: I have had no access to the cellar since 1993 but I had the keys.

Between the 1st and 2nd advocate commissions, the door went missing.

    • 2 Feb 2024 7:37 AM GMT

Jain: It has been stated in the order that the keys of the cellar are with Vyas Parivar. If I did not have the cellar why would I have the keys.

Justice RRA: but what was the need to file the application (for Puja)?

Jain: In the survey conducted by the ASI, it has been found that there was no door and the cellar's possession was taken. Based on the evidence the court appointed the receiver (the DM).

Justice RRA: Once in 2016, you executed a deed and transferred the area to Kashi Vishwanath Trust then what right do you have now?

Jain: As of now my final relief is to be seen by the court. As of now, Kashi Vishwanath trust is doing the puja.

    • 2 Feb 2024 7:34 AM GMT

Jain: The final relief is that I may be permitted to do the puja. The court has granted the right to the Kashi Vishwanath trust to do the puja. My interim and final reliefs are very different.

    • 2 Feb 2024 7:33 AM GMT

Jain: Till date 17th January order has not been challenged. The nature of the suit is that I have filed it as a shivayat. The relief in the application and the suit are completely different.

    • 2 Feb 2024 7:33 AM GMT

Naqvi; both orders are in contradiction to each other.

This court may allow my interim prayer. And not allow them to do anything.

Advocate Vishnu Jain (for original plaintiff): This appeal is not maintainable. The order of 31st Jan is subsequent. The base is the 17th Jan order is not challenged by them.
