The Central government has constituted another Bench of the National Company Law Appellate Tribunal (NCLAT) at Chennai, to hear appeals against the orders of the Benches of the National Company Law Tribunal (NCLT) having jurisdiction of Karnataka, TN, Kerala, AP, Telangana, Lakshadweep and Puducherry.

A notification issued in that behalf by the Ministry of Corporate Affairs on Friday clarifies that the bench of NCLAT at Delhi will remain as the Principal Bench and will continue to hear appeals from NCLT, other than those in the jurisdiction of the Chennai Bench.

Last year, Justice SJ Mukhopadaya, former SC judge and present Chairman of NCLAT, Delhi stressed upon the need for setting up regional benches of the NCLAT. While speaking at a seminar on the Insolvency and Bankruptcy Code at Chennai, Justice Mukhopadaya expressed hope that Centre will set up a permanent bench of NCLAT at Chennai.

The notification will come into force from March 18, 2020.

The move will help to reduce pendency in the NCLAT by reducing burden from the Principal Bench. It will also trim undue travel expense of the litigants from southern-India, who were until now, required to travel to New Delhi.
