A Special Executive Magistrate in Delhi has ordered the release of CJP leaders Ashutosh Ranka and Saurav Das from judicial custody after they gave written undertakings not to commit any breach of peace and assured that they will not call for any protest at Jantar Mantar till the time it remains de-notified as a protest site.

The duo further said that they will conduct any protest within the four corners of the Constitution of India.

The order was passed on Wednesday by Special Executive Magistrate Ritu Raj, who was hearing an application by the Delhi Police seeking a further three-day extension of the duo's judicial custody in preventive proceedings initiated under Sections 126 and 170 of the Bharatiya Nagarik Suraksha Sanhita (BNSS).

In their written undertakings, Ranka and Das assured the court that they would not commit any breach of peace and expressed faith in the judiciary and its institutions, including the court of the Special Executive Magistrate.

The undertakings were taken on record by the Magistrate.

The police had sought a further three-day extension of judicial custody, arguing that the apprehension of a breach of peace and disturbance of law and order persisted in view of the respondents' statements and subsequent conduct.

The police also referred to a media byte given by another member of their group while being taken to Tihar Jail, which the police claimed undermined the authority of the court. In response, counsel for the respondents tendered an unconditional verbal apology and assured that such conduct would not be repeated.

After considering the submissions of both sides and the written undertakings, the Magistrate held that the immediate preventive measures contemplated under Section 135(3) BNSS could be adequately secured by requiring the respondents to execute bonds for keeping the peace.

The Magistrate observed that further judicial custody did not appear necessary at this stage, particularly in view of the undertakings furnished before the court.

Accordingly, Das and Ranka were directed to furnish personal bonds and surety bonds of ₹50,000 each until the conclusion of the inquiry. After being satisfied with the sureties, the Magistrate directed their release and issued a release warrant to the Superintendent of Central Jail, Tihar, for compliance.

The inquiry in the matter will continue, and the leaders have been directed to appear before the court on every date of hearing and maintain peace and public tranquillity in accordance with the terms of their bonds and undertakings.

The matter is listed for further proceedings on October 23 at 3 PM.

Advocate Abhik Chimni along with Advocate Pranjal Abrol appeared for Ranka and Das.
