'Govt Already Addressing Misuse Of AI-Generated Content' : Supreme Court Disposes Of PIL Seeking Guidelines

The Supreme Court on Thursday disposed of a petition filed under Article 32 seeking directions to regulate the misuse of Artificial Intelligence, taking note of the fact the Government of India has already published draft rules on AI regulation for public consultation.Noting that the Government is already engaging with the issue, the bench comprising Chief Justice of India Surya Kant and Justice Joymalya Bagchi disposed of the petition.As soon as the matter was taken, Senior Advocate Arvind P Datar, for Meta Platforms, told the bench that the petition has become infructuous as the Ministry of Electronics and Information Technology (MeitY), in October, published a draft of the proposed amendments to the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, seeking to regulate AI-generated content. The Government has invited public comments to the proposed amendment. Datar said that consultations are taking place on the amendments, with the last meeting held on November 13.Senior Advocate Mukul Rohatgi, also for Meta, made a similar submission.The bench dictated the order as follows :"The instant writ petition has been filed under Article 32 of the Constitution, purportedly in public interest, seeking a direction to the Union of India to frame a comprehensive regulatory framework and licensing for Artificial Intelligence tools including those capable of generating images, videos and audios so as to ensure prevention of misuse. As soon as the petition was taken up, Shri Arvind Datar and Shri Mukul Rohatgi, learned senior counsel representing Meta Platforms, informed that after due deliberations between stakeholders and multiple consultations, the Union of India has formulated the draft rules. The issues thus are being effectively addressed by the Union of India, and therefore there is no necessity for judicial intervention at this stage. The writ petition is accordingly disposed of."The PIL sought a direction to the Union Government to frame a comprehensive regulatory and licensing framework for Artificial Intelligence (AI) systems, especially those capable of generating synthetic images, videos, and audio impersonations of real individuals.The petition, filed by advocate Aarati Sah, urged the court to issue a writ of mandamus to the Ministry of Electronics and Information Technology (MEITy) and the Department of Telecommunications (DoT) to establish a statutory mechanism for the responsible deployment of AI technologies and to ensure accountability from digital intermediaries like Meta Platforms and Google.Case : AARATI SAH Vs UNION OF INDIA | W.P.(C) No. 1127/2025Click Here To Read/Download Order
