Zakia Jarfi, widow of Congress MLA Ehsan Jafri who was killed in the Gulberg Housing Society massacre during the 2002 Gujarat Riots, has approached the Supreme Court through a special leave petition challenging the SIT report which ruled out any "larger conspiracy" by high state functionaries in instigating the communal riots following the Godhra massacre.

Sibal: The material collected by SIT was not related to only gulbarg. The issue was not that only Gulbarg was to be considered, our protest petition, all material had to be sent.

Bench: Therefore, that report was to be filed before Magistrate is what court directed.

Sibal: Yes. Before the court which was considering 67. It was for convenience placed before that Magistrate. Otherwise, what's the point of Amicus & all material.

Sibal: Magistrate said I won’t look at that, as I’ve been asked by SC to only look at Gulbarg society.

Bench: Then let's see the SC order.

Sibal: Even SIT in its report doesn’t limit itself to the Gulbarg.

Sibal for  Zakia Jafri: Our case was, there was a larger conspiracy at play, where there was bureaucratic inaction, police complicity, hate speech and a conspired directed unleashing of violence!!

Sibal: His (the Judge’s) logic is simple, I’m not concerned with any of this.

Bench: Where is the SC judgement being constantly referred to?

      Sibal: That’s the main judgement.

Sibal adds: So he said I won’t look into anything else and will only look at the limited complaint of Zakia Jafri.

Sibal reads out from order: “Taking report produced, protest petition & argued, its stated by SIT that its made investigation according to directions, whereas according to complainant SIT hasn’t produced relevant evidence before the court.”
