Bench: How has the magistrate dealt with this contention?

Sibal: He hasn’t, he has said we are only concerned with Gulbarg society matter.

Sibal adds: State Intelligence messages recovered by SIT were only in part. 

Sibal: If you don’t investigate, file closure report, where do we go!

J Khanwilkar: Your main issue seems to be, the material you wanted to be part of your protest petition has not been taken into account by SIT?

Both SIT & Magistrate. 

Sibal: After SIT files the closure report, I file seeking cancellation of that report. The petitioner files SLP and seeks access to investigation papers. SC vacates stay on pronouncement of judgement. 

Sibal: Evidence is part of the official record apart from one sting operation by Ashish Khaitan, you’ll be shocked if you just look at that. And that has been denied, it hasn’t been taken into consideration at all. 

Sibal: Except Original report by Malhotra that sets out finding that offences were committed.

Bench: That was substantiated by SIT in its report?

Sibal: No, Not true.

Sibal: SIT was already in seizure of several facts which it did not look at all while filing its closure report.

Bench: SIT was constituted under SC order.

Sibal: Yes, 12/9/2011 order.
