    Yesterday, ICAI also submitted a Brief Note to the Supreme Court stating that COVID-19 spread is now at a substantially low level, and that it would be in the best interests of the candidates to hold the examination as per the schedule. 

    The brief note, submitted to the Supreme Court in the plea seeking postponement of the CA exams, as well as opt-out and extra chance options, states that ICAI has a statutory duty under Section 15(2)(b) of the Chartered Accountants Act 1949, to hold the examination and that they are trying to ensure that all mandated COVID-19 protocols will be in place.

    For Opt-Out option, the Brief Notes states that announcement dated 21 June 2021 has allowed opt-out option in case the examinee or his/her family members residing in the same premises are infected with COVID-19 on or after 21 June, and that this option can be exercised on production of COVID-19 positive RTPCR report.

      Srinivasan: We will give the COVID medical criteria to old students. Even for the new students. Not only should they have suffered, but also their relatives/family members. A medical certificate that they are unable to take the exam will also be taken.

      Srinivasan: We have given in this cycle an opt out scheme. We have suggestions which we will put to the institute. The opt out facility will be available to people who are affected by COVID in one form or the other.

      Srinivasan: It is the most conducive time to hold the exams.

      Srinivasan: There are about 850 centres. These are dynamic times. We have to anticipate and can’t have rigid measures. That’s why we have ensured that we will follow all protocols. Last time it was successfully held.

      Srinivasan: For 74 years, this statutory regulator has been holding exams and has gathered sufficient experience. Last year was 45000 cases and now it is 37000. This is a mammoth exercise carried out in India and abroad.

      Bench: If it’s related to COVID only, then only this can be done.

      Arora: Then they should be allowed to give the rest of the exams only.

      Arora: If someone falls sick during the exam and cannot take the last one, the institute gave them an opportunity last time that them not giving the exam was not on their own accord. Otherwise the rule is they will have to give the whole thing again.

      Arora: They have one option in November for old syllabus. If you do allow a self assessment as was done last, you may consider -

      Bench: The person you’re appearing, are they appearing for the first time or last time ?

      Arora: I cannot answer. Maybe my instructing advocate can answer that.

      Srinivasan: The new syllabus was invoked 6 years back.

      Bench: What is the relevance of that fact ? This will be decided by some competent authority.

      Bench: Opt out has to be for a good reason. Someone has to certify and ultimately institute will take a call on that. Otherwise it will be an unending process.
