    Yesterday, ICAI also submitted a Brief Note to the Supreme Court stating that COVID-19 spread is now at a substantially low level, and that it would be in the best interests of the candidates to hold the examination as per the schedule. 

    The brief note, submitted to the Supreme Court in the plea seeking postponement of the CA exams, as well as opt-out and extra chance options, states that ICAI has a statutory duty under Section 15(2)(b) of the Chartered Accountants Act 1949, to hold the examination and that they are trying to ensure that all mandated COVID-19 protocols will be in place.

    For Opt-Out option, the Brief Notes states that announcement dated 21 June 2021 has allowed opt-out option in case the examinee or his/her family members residing in the same premises are infected with COVID-19 on or after 21 June, and that this option can be exercised on production of COVID-19 positive RTPCR report.

      Bench: You are not obliging the institute by appearing in the exam. It is voluntary. You can’t make the institute responsible for your problems and issues.

      Adgaonkar: As far as tests of staff is concerned, they are saying that they can’t do that for them as well.

      Bench: You are not concerned with the examination being held. You are bringing up non-issues.

      Bench: With regard to movement, logistical issues are your responsibility. Present a representation to competent authority. Don’t give us issues like this. There will be authority who will accept or reject.

      Bench: You can’t go creating classes after classes. That issue is related to a matter before another court. We are only concerned with the matter related to the examination. You are going beyond that.

      Adv. Shashibhushan Adgaonkar: One issue is about vaccination.

      Bench: Can this possibility be passed to the institute ?

      Adgaonkar: On the basis of admit card, can priority be given to the students for vaccination ?

      Arora: Last point is now for declaration of the results. Some students had approached the HC and the institute found it defamatory and did not declare the results. It was only after the intervention of the Court that results were declared. Let’s not have a repeat of that.

      Bench: You are asking for too much. That’s a part of the exam. We cannot change it.

      Arora: Last issue is that the matter of articleship. Some will pass the exam, but many have not been able to do the articleship.
