The Supreme Court on Monday was informed that a notice issued to a student, under the BNSS to furnish bonds, in connection with the proposed “Cockroach Janta Party” (CJP) protest in Greater Noida has been withdrawn.

The development came as a bench comprising Chief Justice of India Surya Kant, Justice Joymalya Bagchi and Justice V. Mohana was hearing a petition filed by Gautam Buddh University student Akshat Tripathi challenging the S.126/130 BNSS notice issued against him by the Greater Noida Executive Magistrate.

The notice had directed Tripathi to furnish a personal bond of Rs.5 lakh and two sureties of the same amount for allegedly encouraging fellow students to participate in a proposed CJP dharna.

The petitioner's counsel initially sought a pass-over when the matter was taken up. CJI Surya Kant, however, said there was no need for a pass-over and observed that the Court could quash the notice itself.

Additional Solicitor General Aishwarya Bhati, appearing for the authorities, then informed the Court that the notice had already been withdrawn.

Counsel for Tripathi submitted that the petitioner had not received any notification regarding the withdrawal.

The CJI said the Court would record the position in its order. The Court subsequently recorded the statement made by ASG Bhati that the notice stood withdrawn.

“Ms Bhati has entered appearance. She states that the notice already stands withdrawn. That being so, it is directed that action if any taken in the past pursuant to the notice stands annulled and consequently, no punitive action will be taken against petitioner,” the Court ordered.

During the previous hearing, CJI Surya Kant had questioned how the Executive Magistrate could issue the notice when the Supreme Court had expressly directed that no coercive action be taken against students.

The CJI had indicated that an explanation would be sought from the concerned officer.

The present petition was filed by Tripathi challenging the notice, which had invoked preventive proceedings against him in connection with the proposed protest.
