    Public interest litigation is before the Supreme Court seeking directions for framing of policy to regulate coaching institutes in the interest of the students. PIL is filed by petitioner Pawan Prakash Pathak in the backdrop of recent Surat fire Tragedy in a coaching institute which claimed the lives of 22 students.

    Petition says that there is no law and there are no rules and regulations governing the private coaching institutes and no building bye-laws or local safety laws are observed and institutes are run like profiteering units in violation of the fundamental rights of the students.

    Petitioner wants enforcement of the fundamental rights of the students at large, who take coaching classes for different purposes and also wants regulation of these coaching institutes with respect to advertisements, exorbitant fees they charge, the teacher-student ratio in classrooms and infrastructure of these coaching institutes.

    Petition reads:

    "The coaching classes seem to be running a parallel education system and it won't be wrong to say above par excellence in comparison with the government schools, but the issue is that these organizations are not governed or regularized by the states through law or any statute except few states like Bihar. If regularized, they will have to fall in line as far as certain basic facilities, fees charged and faculty enlisted are concerned." sic

    Petitioner prays for issuance of writ of mandamus or any other appropriate writ to the respondents for regularization of the private coaching institutes and asks for protection of fundamental rights of the students by framing of guidelines or passing of directions to the respondents to look after safety measures which these coaching institutes need to adopt. Petitioner seeks regularization of these coaching institutes by regulation or scheme for these institutes and minimum standards for their operation.
