Supreme Court Agrees To List Plea Seeking Permission For Peaceful Protests In Delhi Amid Agitation Against CEC Gyanesh Kumar

The Supreme Court on Monday agreed to list a plea seeking directions to the Delhi Police to permit peaceful protests in Jantar Mantar in the national capital, amid protests being held in Delhi against Chief Election Commissioner Gyanesh Kumar.
The plea was mentioned before a bench headed by Chief Justice of India Surya Kant.
Appearing for the petitioner, counsel submitted that the Delhi Police was not allowing peaceful protests in Delhi, including protests by students, citizens, office-bearers of registered political parties and Members of Parliament.
"Delhi Police is not allowing peaceful protests. The issue is very important. Neither students nor citizens [are being allowed]," counsel submitted.
The plea comes in the backdrop of protests in Delhi against CEC Gyanesh Kumar, with several political leaders and lawyers participating in demonstrations seeking action against him over issues concerning the functioning of the Election Commission.
The CJI asked the counsel to clarify the relief sought and the nature of the petition.
"What is the relief sought? Who is the petitioner? Is it a PIL?" the CJI asked.
Counsel submitted that the petitioner was seeking certain directions, including a direction to the Delhi Police to permit peaceful protests.
The CJI said the Court would ascertain whether similar matters were already pending before it.
"If some similar matters are there, we will find out. We will only list it, then you argue," the CJI said.
The Supreme Court accordingly agreed to list the matter for consideration.
