Supreme Court Allows Samajwadi Party To Approach Allahabad HC Against Eviction Of Pilibhit District Office

The Supreme Court today(June 16) dismissed a special leave petition preferred by the Samajwadi Party against the Allahabad High Court's order restraining the District Party President, District Pilibhit, from filing further writ petitions in regards to the dispute over eviction of the Party from its district office in Pilibhit. The Court, however, clarified that SP can approach the High Court.As per the SLP, the District Party President, Anand Singh Yadav, filed a writ petition before the Allahabad High Court alleging eviction by the Nagar Palika Parishad, Pilibhit, from the Party's district office. However, the High Court refused to entertain the writ petition and refrained Yadav from filing writ petitions before the high court on the same cause of action. Against this order, the SP approached the Supreme Court, stating that it does not endorse the views of Mr. Yadav, who had filed the writ petition in his capacity. It requested that the relief may be granted for the Party to approach the High Court to seek relief against the alleged eviction from its district office. Senior Advocate Siddhartha Dave, for SP, told a bench comprising Justice Sandeep Mehta and Justice PB Varale, that the due to the High Court's order, the official party is now restrained from moving the High Court, despite that the premises belong to the party and they have been duly paying rent for 16 years.It is the petitioner's case that orders were passed forcibly evicting the petitioner's party on November 12, 2020, without any opportunity of hearing the petitioner. Therefore, the party wants to approach the high court to seek direction to the Chairman, Nagar Palika Parishad, Pilibhit, and the Executive Officer, to decide on the execution of the lease deed in favour of the petitioner, pursuant to the letter of possession dated March 17, 2005.However, before he could continue, Just Mehta suggested that the petitioner must approach the high court to agitate his issues. "What stops you from going to the high court?" he asked.It therefore allowed the petitioner to approach the High Court: "The SLP suffers from delay of 998 days and in addition to, it is clear writ petition preferred before the High Court by one Mr Anand Singh Yadav, claiming to be the President of the petitioner's party. However, the petitioner party alienates itself from the said position. In this view, the writ petition was withdrawn by the aforesaid petitioner before the high court, categorically denying liberty to file a fresh writ petition to the petitioner therein in the same cause of action. We of the firm view that the aforesaid order cannot be treated as prejudicial to the rights of the petitioner.
