Supreme Court Expresses Displeasure Over Registry Not Placing Case Orders In Case File

The Supreme Court on Tuesday (May 14) expressed displeasure about the inaction of the Supreme Court's Registry for not curing the default of non-placing of all the case orders in the case file. The bench comprising Justices Abhay S. Oka and Ujjal Bhuyan stated that despite several orders being passed bringing the default to the notice of the Registry, no corrective steps are being taken by the Registry to cure the default of non-placing of the case orders in the case file. “This is one more glaring case where copies of the order passed on 22.01.2024 and 26.02.2024 are not being placed on record. Though we pass several orders inviting the attention of the registry to list default, we find that no corrective steps are being taken.”, the court said. The Court directed the Court Master to forward a copy of this order to the Secretary General of the Supreme Court. This is not the first time that the Supreme Court expressed displeasure over the functioning of the Supreme Court's Registry. Last week, the bench headed by Justice JK Maheshwari sought an explanation from its Registrar (Judicial) against the listing of the case without following the proper procedure Previously, a bench led by Justice Abhay S Oka noted with dismay that a civil appeal ought to have been listed on a Thursday, as directed, instead of Friday when it was listed. Justice Oka orally observed, "What is worrying is that some members of the staff have bye-passed the judicial order directing listing of the civil appeal." Also, the bench led by Justice (Retd.) Aniruddha Bose pulled up the Registry for not listing a matter related to Adani Power Rajasthan Ltd despite a judicial order to post it on 23.01.2024. In another case, Justice Oka last year pulled up the registry for shifting the blame on court masters for non-compliance with the court's orders, calling it a 'very sorry state of affairs'.
