Supreme Court Grants Bail To 3 Accused In Sambhal Violence Case

The Supreme Court today(October 27) granted bail to three persons accused in the case over the violence that took place on November 24 last year during the court-ordered survey of the Sambhal Jama Masjid mosque to determine whether a temple existed at the premises.A bench comprising Justice PS Narasimha and Justice R Mahadevan passed the order. The three accused persons are Danish, Faizan, and Nazir, who were involved in various cases and were represented by Advocate Sulaiman Mohd Khan.Faizan and Danish challenged the May 19 order of the Allahabad High Court, wherein the single judge dismissed their plea for bail.FIR No. 337/2024 stems from the alleged incident which occurred when the district as well as police administration geared up to facilitate the survey of Jama Masjid in compliance with the November 19, 2024, order passed by Civil Judge(Senior Division), Chanduasi, District Sambhal in civil suit no. 182/2024. According to the allegations in the FIR No. 337/2024, several miscreants gathered on the spot to protest the survey, and subsequently, the protest turned violent as people indulged in stone pleting as well as firing, resulting in injuries to police personnel and damage to their vehicles. FIR was lodged on charges of sections 191(2), 191(3), 190, 109(1), 125(1), 125(2), 221, 132, 121(1), 121(2), 324(4), 323(B), 326(F) of Bharatiya Nyaya Sanhita (BNS), 2023 and section 7 Criminal Law Amendment Act (CLA), 1932 as well as sections 3 and 4 of Prevention of Damage to Public Property Act 1984 and under sections 3, 25 and 27 of Arms Act, 1959. Nazir has challenged the May 28 order of the Allahabad High Court in FIR 304/2024 and FIR No. 305/2024. Offences against him in FIR No. 305/2024 are under sections 191(2), 191(3), 190, 109(1), 125(1), 125(2), 221, 132, 121(1), 121(2), 324(4), 323(B), 326(F) of BNS, 2023 and section 7 of CLA as well as sections 3 and 4 of Prevention of Damage to Public Property Act 1984 and under sections 3, 25 and 27 of Arms Act, 1959.FIR No. 305/2024 are under Sections 191(2), 191(3), 190, 109(1), 117(2), 132, 121(2), 223(B) of BNS, 2023 and section 7 of CLA as well as sections 3, 25 and 27 of Arms Act, 1959.
